What is the New Legal Provision ?

Union Home Minister Amit Shah is introducing a historic bill in the upcoming monsoon session of Parliament—the ‘Prevention of Insults to National Honour (Amendment) Bill, 2026’. Under this new law, if anyone deliberately insults ‘Vande Mataram’, obstructs its singing, or causes a disturbance in any gathering, they will face up to 3 years in jail, a heavy fine, or both.

No Statutory Rules for Vande Mataram

In fact, under the existing 1971 law, these stringent provisions were applicable only to the insult of the national anthem ‘Jana Gana Mana’, our national flag, and the Constitution. The national song was outside this legal protection. Even the Supreme Court had previously stated that there were no statutory rules for ‘Vande Mataram’.

But now, with this new amendment, ‘Vande Mataram’ will also get the same status and full legal protection as the national anthem. The Union Cabinet has already given its green signal to this bill.

New Guidelines from the Ministry of Home Affairs Regarding Vande Mataram

The Union Ministry of Home Affairs (MHA) has recently issued some important guidelines regarding the honour of the national song. According to these, in all official and government programs where the national anthem is played or sung, the presentation of the national song ‘Vande Mataram’ will also be mandatory.

If both are being presented together in a program, the national song ‘Vande Mataram’ will be sung or played first, and immediately after that, the national anthem will be presented. Apart from this, instructions have been given to pay special attention to the purity of words, correct script, and precise pronunciation during the singing.

The Central Government is set to introduce the ‘Prevention of Insults to National Honour (Amendment) Bill, 2026’ on July 20, 2026, during the monsoon session, under which insulting the national song ‘Vande Mataram’ will become a punishable offense. This proposed law will provide legal protection and dignity to ‘Vande Mataram’ equal to that of the national anthem and the national flag.
