How did the idea of the 130th Amendment Bill in the Constitution come up and what was its basis?
Opposition parties have many apprehensions about the 130th Amendment. Opposition parties say that if it becomes a law, it can be misused by the government to harass governments in non-BJP ruled states. In such a situation, the biggest question is how did the idea of the 130th Amendment Bill in the Constitution come up?
There was a time when the question came as to who would hoist the flag in Delhi on 15 August 2024? Then the Chief Minister of the state Arvind Kejriwal was lodged in Tihar Jail on corruption charges. Then the court expressed its inability to remove him, citing the provision of the Constitution and law of the country that no one’s resignation can be sought without being proven guilty or punished.
How did the idea of this bill come?
The question started coming to the mind of the central government and its senior ministers that why did the makers of the Constitution not think of any law for such a situation. After much thought, it was decided that the place of honesty in politics is becoming a thing of the past and the importance of public shame is decreasing among politicians.
Every aspect of society has deteriorated, so politics is also not untouched by it. A minister said that shamelessness is now taking the place of information. In such a situation, there is a need for such a law that a situation like Delhi cannot be created again.
While presenting the 130th amendment of the Constitution in the Lok Sabha on Wednesday, Home Minister Amit Shah said that a case was also filed against him and he also went to jail, but when the time came to go to jail, he resigned before that and did not take any post in the government until the cases against him were discharged.
Opposition parties have many apprehensions
However, opposition parties have many apprehensions about this constitutional amendment. While presenting the bill in the Lok Sabha, AIMIM chief Asaduddin Owaisi, Manish Tiwari from Congress, KC Venugopal, Dharmendra Yadav from Samajwadi Party expressed apprehensions of misuse of this bill against opposition parties. Opposition parties say that if the law is made, central agencies can be misused to harass governments in opposition party states and it can be used politically against their chief ministers.
Huge uproar in Parliament over this
In protest against this bill, all the parties of India Alliance including Trinamool Congress, Samajwadi Party, Congress reached the well of Lok Sabha and created a ruckus, tore copies of the bill, there was a situation of pushing and shoving. But the bill was presented, Home Minister Amit Shah discussed it in detail and requested to refer it to JPC to take the opinion of all political parties. In the next one or two days, after consulting all the parties, the Lok Sabha Speaker will form a JPC of 31 members. This JPC will be asked to submit its report to the Lok Sabha by the last day of the first week of the upcoming session of Parliament.
However, if the fear of the opposition parties about the political use of this bill is addressed by the central government, then it will certainly be difficult to question the intention behind bringing this bill. The way the court had shown helplessness in the case of the Chief Minister of Delhi, this bill can be considered the need of the present time.
